01The agreement
By using Urban Safety, you agree to these Terms. They form a binding agreement between you and Urban Safety, Inc.
These Terms of Service ("Terms") cover your use of the Urban Safety mobile app, website, backend, support channels, subscription features, and related services (together, the "Service"). The Service is provided by Urban Safety, Inc., 68 Jay Street, Suite 412, Brooklyn, NY 11201, USA ("Urban Safety," "we," "us," or "our").
Urban Safety is a personal safety timer and alert companion. It is not an emergency service, security company, rescue service, monitoring center, medical service, or substitute for calling local emergency services. If you are in immediate danger, call your local emergency number.
If you do not agree to these Terms, do not use the Service. If you use Urban Safety on behalf of another person or organization, you confirm that you have authority to accept these Terms for them.
02Definitions
03Eligibility & account
You must be at least 16 years old and old enough to consent to these Terms in your location. Do not use Urban Safety if you are prohibited from using it under applicable law.
You are responsible for keeping your profile information accurate, especially your name and the names and phone numbers of your Emergency Contacts. Alert messages can be misleading or fail if this information is wrong.
You are responsible for your device, app access, PIN, and biometric settings. A PIN is used to protect critical alert-cancellation flows. Biometric authentication, if enabled, is handled by your device operating system.
04What the service does (and does not do)
What Urban Safety does
- Lets you start a timed or live Safety Session.
- Lets you choose which Emergency Contacts are included for a session.
- Schedules local reminders and grace-period notices where device permissions allow.
- For timed sessions, can store a pending server-side fallback payload so selected contacts can be alerted if you do not check in before the timer and grace period expire.
- Lets you send test alerts and urgent manual alerts.
- Shows session history, routines, delivery status, subscription status, and support options.
What Urban Safety does not do
- It does not call police, fire, ambulance, rescue, or dispatch services for you.
- It does not guarantee that SMS, WhatsApp, push notifications, maps, GPS, cellular networks, or app stores will work.
- It does not guarantee that your Emergency Contacts will see, understand, or respond to an Alert.
- It does not provide continuous monitoring or human review of your location.
- It does not provide medical, legal, transportation, law-enforcement, or professional safety advice.
05Your emergency contacts
You are responsible for the people you add as Emergency Contacts.
- You confirm that you have the right to provide each contact's name and phone number to Urban Safety.
- You agree to tell each Emergency Contact that you added them and that they may receive alerts from the Service.
- You agree to remove a contact promptly if they ask you to remove them.
- You agree not to use Urban Safety to harass, threaten, stalk, impersonate, or surveil anyone.
Carrier, Twilio, WhatsApp, Apple, Google, or local telecom rules may affect whether messages are delivered, delayed, blocked, or marked as undeliverable.
06Subscriptions & billing
Urban Safety offers a free plan and an optional paid plan called Urban Safety Care. Care features, limits, prices, billing periods, trials, and promotions are shown in the app at the time of purchase.
Subscriptions are processed by Apple's App Store or Google Play and managed through RevenueCat. Your subscription may renew automatically unless you cancel through the applicable app-store account settings before the renewal deadline set by Apple or Google.
Refunds, cancellations, billing disputes, taxes, payment methods, receipts, and renewal rules are controlled by Apple or Google, depending on where you purchased. Cancelling a subscription usually stops future renewals but does not automatically refund prior charges or remove access for the already-paid billing period.
07Acceptable use
You agree not to:
- Use the Service for unlawful, deceptive, abusive, or harmful purposes.
- Use the Service to surveil, stalk, threaten, harass, or impersonate another person.
- Add someone as an Emergency Contact without a reasonable basis to believe they consent or should know.
- Submit false, misleading, or abusive alerts, support requests, or contact information.
- Reverse engineer, probe, scrape, overload, disrupt, or bypass Service restrictions except where law allows.
- Use automated systems to create alerts, tickets, accounts, subscriptions, or traffic that burden the Service.
We may throttle, block, suspend, or terminate access if we believe your use creates risk, violates these Terms, violates third-party platform rules, or may expose Urban Safety or others to legal or operational harm.
08Intellectual property
The Service, including the Urban Safety name, logos, software, interfaces, designs, content, and documentation, is owned by Urban Safety, Inc. or our licensors and is protected by intellectual-property and other laws.
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose and in compliance with these Terms. You retain rights to content you provide, such as names, notes, support messages, and contact details, but you grant us permission to process that content to operate, secure, support, and improve the Service.
09Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or available in every location or circumstance. We do not warrant that alerts will be delivered, that location or address data will be accurate, that contacts will respond, or that any particular safety outcome will occur.
Some jurisdictions do not allow certain disclaimers. In those jurisdictions, the disclaimers apply only to the fullest extent permitted by law.
10Limitation of liability
To the maximum extent permitted by law, Urban Safety, Inc. and its directors, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, loss of goodwill, personal injury, death, property damage, third-party conduct, or failure of emergency services, carriers, messaging providers, app stores, networks, devices, or maps.
To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of one hundred U.S. dollars or the amount you paid to Urban Safety for the Service during the twelve months before the event giving rise to the claim. This limitation does not limit liability that cannot be limited under applicable law.
11Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Urban Safety, Inc. and its directors, officers, employees, contractors, affiliates, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your breach of these Terms, your violation of law, your misuse of alerts, or your violation of another person's rights, including the rights of Emergency Contacts.
12Termination
You may stop using the Service at any time by deleting local data, uninstalling the app, and cancelling any active subscription through Apple or Google. We may suspend, limit, or terminate access if you violate these Terms, create risk for others, cause operational harm, or if we must do so to comply with law or platform rules.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute terms, and payment obligations incurred before termination.
13Disputes & governing law
These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-law rules, except where mandatory consumer-protection law in your place of residence requires a different rule.
Before filing a claim, you agree to contact us at legal@urbansafety.app and give us a reasonable opportunity to resolve the dispute informally. If a dispute proceeds in court, it will be brought in the state or federal courts located in New York, unless applicable law gives you a mandatory right to bring the dispute elsewhere.
14Changes
We may update these Terms as the Service changes. If a change materially affects your rights or obligations, we will provide reasonable notice in the app, on the website, or by another appropriate channel when required by law. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
